How Billy Walters was beat at his own game

LAS VEGAS - Thanks to the accurate photos by TravelGolf.com editor Chris Baldwin detailing the horrific conditions at Stallion Mountain in East Las Vegas, a sweetheart land deal was today squelched by the Nevada Attorney General -- at least for the time being.

The photos clearly demonstrate that Billy Walters has no intention of adequately maintaining several of his East Las Vegas golf courses, and would obviously prefer to convert one or more into cracker box houses and condos. I was able to share these photos electronically with local elected officials therefore putting the heat on the Las Vegas City Council who were Hell bent to give away valuable taxpayer-owned land to the politically connected golf course developer-cum-home builder. However, after seeing the dilapidated condition of one of Walters' courses, even the most squeamish council member took pause.

Maverick Councilman Steve Wolfson, after learning that Walters' former criminal defense attorney Oscar Goodman had advance knowledge of altered information provided the council, and other information withheld from the council to benefit Walters, boldly brought the November 2 approval of the lifting of a deed restriction limiting the subject 160 acres to golf course only, back for a reconsideration hearing scheduled to be held on Wednesday, November 16.

Moments prior to the reconsideration item being heard on the council agenda, the Nevada Attorney General contacted Mayor Goodman to inform him that the AG's office is opening a criminal inquiry on the Walters issue. This, after Goodman's obedient city attorney, Brad Jerbic, said the statute of limitations had expired, and no criminal action could be taken.

It was obvious that all the hullabaloo raised over this issue had caught the AG's attention up in Reno. Based on the AG's intervention, Goodman was forced to move to rescind the removal of Walters' deed restriction of Nov. 2, and table Councilman Wolfson's reconsideration item until the completion of the AG's investigation. Goodman's motion passed 7 to 0 leaving Walters' grandiose plans in limbo.

Prior to the vote, Walters' attorney, former U.S. Senator Richard Bryan, asked the council to not rescind the deed restriction removal, and just table the reconsideration item.  Had that occurred, it may have been possible for Walters to sell the non-deed restricted land prior to the end of the AG's investigation, and leave the taxpayer's holding the bag.

Walters bought the city owned land for a song in 1999 with the caveat that it be perpetually deed restricted to golf course -- an open space intended to act as a buffer to odors emanating from the city's sewer plant. (Odors were not evident while golfing there recently, however.) After claiming he was losing money, his friend the mayor lead the charge to lift the deed restriction on November 2, and the mayor's obedient, but completely uninformed council, followed his lead with the exception of Councilwoman Lois Tarkanian who was the lone vote to deny Walters' request to build houses within 20 feet of the sewer plant.

(Yes, Lois is the wife of former UNLV basketball coach Jerry Tarkanian.)

It was learned one day after the Nov. 2 vote that if any future homeowners complained about sewer odors, the taxpayers would be liable to mitigate the odor problem to the tune of up to $30 million dollars. This didn't phase Walters/Goodman. The information was conveniently lifted from the reports given the council members, but was admittedly known by the mayor prior to his vote to enrichen his former client and friend according to the LV Review Journal.

In the words of Las Vegas CityLife Editor Steve Sebelius, "Getting $7.2 million is better than getting nothing and perhaps watching the course deteriorate the way Walters' courses tend to do when he prefers homes to fairways and greens."

Sebelius' words only reinforce the notion that Billy Walters sometimes lets certain of his "golf courses" deteriorate or remain undeveloped if he -- within a few years of purchase or lease -- envisions more profit by conversion to a higher and better use such as little houses or shopping centers nobody saw coming. Unfortunately, several of his courses were once owned by the taxpayers, and in order for him to to buy the public land on the cheap, he had to agree to keeping the land as golf courses almost indefinitely. But that didn't stop Billy Walters from trying to convert. Today, its the Royal Links that's threatened. Two years ago, two courses located at Stallion Mountain next door to Royal Links were converted -- to the horror of the homeowners!

If Royal Links is eventually converted, what about the rights of the existing home owners who bought golf course frontage? Also, who'll pay for roads, police, fire stations, schools, etc., that will be needed when the thousands of new residents move onto what was once guaranteed to be golf courses? Walters' attorneys, the mayor, or the city attorney, offer no explanation.

During the weekend, over one hundred homeowners who live on or near Royal Links and Stallion Mountain signed a petition asking that their golf course environment be protected. Because of Wednesday's delay, the petition will now continue to be circulated in the endangered areas, and will be presented if or when the LV City Council hears this case again. Petitioners report that when homeowners see the TravelGolf.com photos of Stallion Mountain, they immediately sign. One homeowner showed the petitioner his own photos of what Stallion Mountain has become just outside his back door. His photos were reportedly more shocking than those taken by TravelGolf.

In the meantime, while the AG and Ethics Commission do their thing, below is a chronology of communications including persistent E-Briefs I sent to over 10,000 subscribers outlining the events leading up to today's sensible decision, including links to related stories in the media.

In totality, these missives, linking to hard hitting newspaper articles by Review Journal city hall reporter David McGrath Schwartz, Las Vegas SUN columnist Jon Ralston, Las Vegas CityLife Editor Steve Sebelius, the Review Journal Editorial Board, and a record of recent bundled campaign contributions paid to city council members and the mayor that I included with most E-Briefs, along with a well timed ethics complaint filed by myself and ethicist Robert Rose, pounded the point home, alerted the Attorney General, and showed the citizens of Las Vegas how to beat a political powerhouse at his own political game.

Now it will be up to state law enforcement officials to get to the bottom of one of the most intriguing sweetheart land deals and political conflicts of interest in recent Sin City history.

Any member of the city council who voted in the majority on an item during a council meeting, has five working days to bring the item back for Reconsideration. Councilman Steve Wolfson voted with the majority to give Walters the Moon. Now, the question is whether Wolfson has the balls to go against Goodman, and place the Walters' item back on the agenda for reconsideration?

Goodman's bribe came years before Wednesday's council meeting. Its extent was indicated by the value of Billy Walter's LV Country Club home which Goodman accepted as collateral for his legal fee, then only disclosed a portion of this information after Robert Rose and I filed an ethics complaint against him. The LV SUN on October 16, 2001, quoted Goodman saying, "If I have a choice, if you know somebody and they're honorable, and you've done business with them in the past, they get the best of it," and then promptly, without disclosing his ties to Walters, Goodman voted to grant him a lucrative city contract, hence our complaint.

During Wednesday's hearing, not one councilmember had the courage to question Walters' attorney, former U.S. Senator Richard Bryan, when he made two outrageous statements: No other parties were interested in purchasing the 160 acres (it had never been advertised for sale); and that Walters will now lose his investment of $27 million -- the purported cost of building the golf course, and this offsets the $28.1 million he gained by the lifting of the "permanent" deed restriction (he charged green fees of  $176 - $295 for six years, and never offered a discount to locals as he had promised in 1999). Other items not questioned: the danger of building homes within 20 feet of explosive methane gas; and whether the odor abatement (cost: $5 - $38 million taxpayer dollars) would be necessary if homes were not built so close?

During yesterdays Mayor's Press Conference, when questions began being asked about the Walters deal, city Public Information officer David Riggleman (obediently) interrupted, saying the mayor had a previous engagement. Goodman, like a coward, left the room with the questions hanging.
 
Then, Goodman's Public Relations expert found the perfect story to distract from the Walters giveaway -- Goodman's "cut off their fingers" statement, and his popularity grew. -- SM

The press has no subpoena power. No authority to compel anyone to talk -- under oath or otherwise. No power to fine, jail or punish. All we can do is flip on the white light of public scrutiny and watch the bureaucratic cockroaches skitter. As for that assumption that the five-year federal statute of limitations has lapsed, a news story this past week quoted one lawyer as saying, "If somebody still has the benefit of what was a crime, it's not a stretch to argue that it is a continuing crime." He said if he were the U.S. attorney he would impanel a grand jury and subpoena all the players for testimony under oath.

Las Vegas Mayor Oscar Goodman, once Bill Walters' attorney, says it's all water under the bridge, that it happened a long time ago, and you know, I'm giving some of the money I made on the gin deal to the city. Isn't that wonderful? Goodman however did invite several city officials, some former officials, and others financially or politically interested to be at Wednesday's meeting. It's believed that ten people have been invited and it isn't known how many might actually show up. The original dealings with Walters and the city took place during the time that Jan Jones was mayor of Las Vegas. There is some question that Goecke may testify and that questions about Jones's participation in his actions could come to the council table. According to the city attorney's office the statute of limitations had run out on Goecke's alleged actions and no charges were filed. Many attorneys have questioned this thinking. One particular attorney who is familiar with Nevada and federal statutes, but who wishes to remain anonymous told the Nevada Observer that federal racketeering and conspiracy laws are such that if the alleged crime is continuing, and the action before the city council means it is continuing, then the statutes of limitation rules don't apply.

After this revelation by Goodman, and the setting up of Richard Goecke to take the fall for the Jones/McDonald 1999 land scam, its imperative that a Federal Grand Jury be impaneled to subpoena Goecke to testify. Richard is an honest, albeit passive man, who did exactly as he was told during the years I served with him at city hall, and probably held true to form during the Jones/McDonald administration. I know he will not be anyone's scapegoat! Its time for the U.S. Attorney to supersede the limited authority of Goodman's stooge, City Attorney Brad Jerbic, and fully investigate this crime against the citizens of Las Vegas. -- SM

Mayor Oscar Goodman acknowledged Monday that he knew of possible wrongdoing by a city official before a controversial vote to allow homes to be built on golf course land.

Goodman said he knew of allegations that in the 1990s the public works director had violated city rules to help developer Bill Walters acquire city land and then develop a golf course on the land.

Peter "Chris" Christoff (702-496-0037) lives near Billy Walters' land, and is walking door to door gathering signatures to present to the city council. Christoff reports that the reaction is very strong, and almost everyone he visits signs the petition -- over 100 homeowners by late Mon. Christoff has called the mayor and council offices demanding equal time with Jones, McDonald, or whoever else shows up to defend Walters on Wednesday. On August 20, 2003, Mayor Goodman had Mr. Christoff removed from the chambers before he was able to present a petition protesting another of Goodman's cronies getting free city land. -- SM

Another sweetheart deal with Walters. Once again, faced with the chance to demand Walters pay full price for the land, the City Council falters, and agrees to accept his offer, thus showering Walters with at least $28.4 million in taxpayers' money. And in the process, they've destroyed the buffer and allowed homes to be built as close as 20 feet to the sewage treatment plant. If future homeowners in what should become known as Sweetheart Heights sniff odors from the plant, the city is on the hook -- potentially to the tune of millions -- to fix it... "This is the best we could do under the circumstances," says Goodman. "To me, it was a benefit to the city." How does the mayor figure? Getting $7.2 million is better than getting nothing, and perhaps watching the course deteriorate, the way Walters' courses tend to do when he prefers homes to fairways and greens. Still, one wonders what would have happened had the council had the courage in joining Councilwoman Los Tarkanian in saying no. Might Walters, who stands to profit in the deal, have upped his offer and made the taxpayers whole? We'll never know now. These photos show the planned demise of Walters' golf courses in East Las Vegas. Its obvious that these courses were never intended to succeed as golf courses by their dilapidated and neglected condition, and were built on discounted taxpayer land as shams to later be converted into cheap houses and condos to be sold at an outrageous profit by Walters. Who will pay to mitigate the sewer plant stink? Who will pay for new roads, schools, police, etc. to service the thousands of new residents if Walters/Goodman get their way tomorrow? Goodman controls Councilman Gary Reese, and possibly will bully Councilmen Lawrence Weekly, Councilman Steve Ross, and Councilman Larry Brown into once again voting for Walters. Goodman had egg on his face this morning when he again contradicted himself by saying he was not aware of improprieties prior to his Nov. 2 vote to enrich his former client Billy Walters. City Attorney Jerbic also looked ridiculous after he repeatedly said the five year statute of limitations had run out, then the AG takes the case! It was a good day for the good guys. The document (below) deeding Billy Walters' Las Vegas Country Club home to Oscar Goodman tells it all. Goodman's one half million dollar legal fee was secured by Walters' home in the late 1980's. Goodman did not reveal this fact until Nov. 2, after Robert Rose and I filed an ethics complaint against him. On Nov. 2, Goodman said, "Because there is an ethics complaint filed against me, I want to disclose that I once represented Mr. Walters, but that was a long time ago." He then turned to his stooge Brad Jerbic, the city attorney, who said, "That relationship ended years ago and is not relevant to the proceedings at hand. Therefore, a disclosure is not necessary." Goodman took his payoff years ago, and now is doing everything in his power to reward Walters, even if it costs the taxpayers millions of dollars. -- SM

Environmental officer warns of harm to sewage treatment plant

The city's environmental officer blasted Tuesday a deal that would allow a developer to turn a golf course next to the city's sewage treatment plant into a 1,200-home subdivision and said it will cost taxpayers an additional $30 million... "To jeopardize that (sewage treatment) facility's compliance to make one person richer, who's already rich, makes no sense to me," Wohletz said. She said she warned City Manager Doug Selby before the council voted on the matter on Nov. 2 that the city was getting a bad deal if it removed the restriction on developing the golf course into homes. To reduce odors at the sewage treatment plant to protect its new neighbors would cost the city $30 million, she said... When Wohletz was asked why she was coming forward now, she told a reporter, "Because you called me." In her letter to Reese, dated Nov. 4, Wohletz wrote: "I am fully prepared to resign immediately if necessary. My last boss, Michael Naylor, once told me that if my ethics were bothering me then it was time to find another job. I always thought that was some of the best advice that I was ever given."

EDITORIAL: Who will speak for taxpayers?

City Council must ask, answer a lot of tough questions about Walters deal

Mayor Oscar Goodman acknowledged Monday that he knew of the allegations when he cast his vote to enrich Mr. Walters. But Councilman Steve Wolfson didn't appreciate the lack of full disclosure, so he returned the issue to today's agenda at City Hall. The council will consider rescinding last week's vote, and many key figures and former elected officials associated with the deal are expected to be on hand.

* Why do Goodman and at least Larry Brown say they knew of no allegations of criminal behavior when Selby, through a spokeswoman, says he briefed the council on the Metro allegations? * Why shouldn't Brown and Gary Reese have to explain why they voted for Walters to get the land in 1999 and then change the terms of the agreement in 2005? * If, as Goodman said, that he heard that the method of valuing the land to arrive at $7.2 million was discussed in 1999, why don't Brown and/or Reese explain if that was brought up then? And in the unlikely event it was, doesn't that mean they agreed to a ridiculous -- dare I say sweetheart? -- deal six years ago, with nothing in it for the city and everything in it for Walters?

            This article discloses that Mayor Goodman knew of possible wrongdoing by a city official (Goecke) before his controversial vote for the enrichment of his former client, Mr. Walters.

           

            During the October 19, 2005 city council meeting, Mayor Goodman stated that, because there is an ethics complaint pending against him, he needs to disclose that he was the criminal defense attorney for Mr. Walters in the late 1980s. He then referred to his city attorney who stated that the business relationship was old, and no longer relevant enough to require public disclosure.

 

            This forced disclosure is the first time Mayor Goodman has made this information available to the public since 2000, and would probably have gone ignored had our Request for Opinion not been filed.

Councilman Steve Ross received a total of $5,000 in campaign contributions from Billy Walters' companies NOT INCLUDING the proceeds from fundraisers at Cili Restaurant. Reports show Ross paid $686.00 for the privilege of meeting Mr. Walters' friends at Cili. Funds raised at the Cili events were not separated from other contributions, therefore the persons who attended the parties are not known, nor are the amounts they donated at the events.

Mayor Oscar Goodman charged Walters an estimated one-half million dollars for legal services in the late 1980's that were secured by Walters' LV Country Club home. Mayor Goodman DID ACCEPT several fund raisers at Cili Restaurant and paid $10,000.00 for the privilege of meeting Walters' friends which was offset by $20,000 in In Kind contributions from Mr. Walters. Funds raised at the Cili events were not separated from other contributions, therefore the persons who attended the parties are not known, nor are the amounts they donated at the events.
